Terms & Conditions
These terms govern your use of the Profluence platform, membership, events, and services.
1. Acceptance of Terms
By accessing the Services, you agree to be bound by these Terms and Circle's Terms of Service. The organization reserves the right to modify these Terms at any time, and continued use indicates acceptance of changes.
2. Platform and Eligibility
Services are hosted on Circle. Users must be at least 18 years old or have parental consent. You must provide accurate information and can be refused service at the organization's discretion.
3. Community Guidelines
Prohibited actions include posting defamatory or abusive content, harassment, unauthorized advertising, spam, and violating intellectual property rights. Violations may result in content removal and account termination.
4. User Content
You retain ownership of submitted content but grant the organization a non-exclusive, worldwide license to use, store, display, and distribute it for operational purposes.
5. Privacy
Information collection is governed by the Privacy Policy. Both the organization and Circle may access user data if required by law or to enforce these Terms.
6. Intellectual Property
All platform materials are protected by copyright and trademark law. Unauthorized use without written permission is prohibited.
7. Account Cancellation
Cancellation takes effect immediately upon written request. All data is permanently deleted. Fees are non-refundable. Requests must be submitted at least 24 hours before billing.
8. Payment Authorization & Auto-Renewal
Subscriptions automatically renew monthly or annually unless canceled 24 hours before the next billing date. Users are responsible for updating payment information.
9. Third-Party Content and Links
The organization is not responsible for third-party websites or content accessed through links.
10. Marketing and Promotional Use
By joining, members grant the organization rights to use company names, logos, and images in marketing materials unless written opt-out is requested.
11. Force Majeure
Neither party is liable for failures caused by uncontrollable events like natural disasters or technical failures.
12. Disclaimer of Advice
Content is for informational purposes only and should not be considered legal, business, investment, or tax advice. Users must consult professionals independently.
13. No Guaranteed Outcomes
Membership does not guarantee funding, investment, or business success.
14. Restrictions on Content Sharing
Members-only content cannot be copied, distributed, or shared without express written permission. Violations result in account termination without refund and potential legal action.
15. Non-Solicitation, Non-Compete, and Confidentiality
For 12 months after membership ends, members cannot solicit other members, promote competing services, create competing platforms, or leverage insights gained from membership. Violations may result in termination and legal action.
16. Dispute Resolution and Arbitration
Disputes are resolved through binding arbitration per Circle's Terms of Service. Members waive jury trial and class action rights.
17. Modifications to Terms
The organization may modify these Terms at any time. Continued use constitutes acceptance.
18. Governing Law
These Terms are governed by Florida law. Disputes are resolved through courts in St. Petersburg, Florida, subject to arbitration requirements.
19. Agreement to Terms
By registering or accessing the platform, you acknowledge agreement to these Terms and Circle's Terms of Service.
